TERMS OF USE

Welcome to iepurgentcare.com (the “Website”), operated by IEP URGENT CARE, PLLC (“IEP Urgent Care,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of this Website, including its content, features, appointment scheduling tools, online forms, and other services made available through the Website.

By accessing or using this Website, you agree to these Terms of Use. If you do not agree, please discontinue use of the Website.

1. Purpose of the Website

This Website is intended to provide general information about IEP Urgent Care, our services, locations, hours of operation, providers, and available appointment or contact options.

Information provided through this Website is for general informational and educational purposes only. Although we make reasonable efforts to keep information current and accurate, we do not guarantee that all Website content is complete, accurate, current, or available at all times.

2. No Medical Advice or Emergency Services

The information available on this Website is not intended to replace professional medical advice, diagnosis, or treatment. You should not rely on Website content as a substitute for consultation with a qualified healthcare professional regarding your individual medical needs.

If you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on this Website, online forms, email, or appointment requests for emergency assistance.

Use of this Website does not establish a physician-patient relationship or other healthcare provider-patient relationship. Any such relationship is established only through the appropriate clinical processes and acceptance of care by an authorized healthcare provider, in accordance with applicable law.

3. Appointments and Availability

Our Website may provide a link to Epic or an Epic-powered patient portal or scheduling platform (the “Scheduling Platform”) to allow patients to request or schedule appointments with IEP Urgent Care.

When you select the appointment scheduling link, you may be directed to a third-party website or platform operated, hosted, or supported by Epic Systems Corporation or another service provider on our behalf. Your use of the Scheduling Platform may be subject to additional terms, conditions, privacy notices, and policies applicable to that platform.

Submitting an appointment request does not guarantee an appointment, a particular appointment time, access to a specific provider, or the availability of a particular service. Appointments are subject to confirmation, provider availability, operating hours, clinical appropriateness, and other applicable requirements.

IEP Urgent Care reserves the right to modify appointment availability, services, operating hours, and scheduling procedures as permitted by applicable law.

We do not guarantee the uninterrupted availability or error-free operation of third-party scheduling services. To the extent permitted by applicable law, IEP Urgent Care is not responsible for interruptions, technical errors, or service failures attributable to third-party platforms outside our reasonable control. Nothing in this section limits our obligations regarding patient information, privacy, security, or healthcare services under applicable law.

Online scheduling is not intended for medical emergencies. If you are experiencing a medical emergency, call 911 immediately. If you require urgent medical attention, do not delay seeking care while waiting for an appointment confirmation.

Your use of the Website may involve the collection or submission of personal information. Our collection, use, disclosure, and protection of information are described in our Privacy Policy, available at [Insert Privacy Policy URL].

Please do not submit sensitive medical information through general contact forms, ordinary email, or other channels unless we have specifically identified the channel as appropriate for that information.

Where applicable, patient health information will be handled in accordance with applicable privacy and security laws, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA), as applicable.

These Terms of Use do not replace our Notice of Privacy Practices, any required patient consent or authorization, or any other privacy notice or agreement applicable to healthcare services.

7. Third-Party Websites and Services

We do not control and are not responsible for the content, availability, privacy practices, security, or policies of third-party websites or services. Your use of those services may be subject to separate terms and conditions and privacy policies.

The inclusion of a third-party link does not necessarily constitute an endorsement of that provider or its services.

8. Website Availability and Disclaimer of Warranties

We strive to maintain a reliable and secure Website but do not guarantee that the Website will always be available, uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited.

9. Limitation of Liability

To the fullest extent permitted by applicable law, IEP Urgent Care and its owners, officers, employees, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your access to or use of, or inability to access or use, the Website or its content.

This limitation applies to claims arising from Website interruptions, technical errors, reliance on general Website information, or third-party websites and services.

Nothing in these Terms limits liability for matters that cannot lawfully be limited or excludes rights or remedies that cannot legally be waived. These Website provisions do not replace or modify any applicable legal obligations relating to the provision of healthcare services.

10. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, damages, liabilities, and reasonable expenses resulting from your unlawful use of the Website or your material violation of these Terms, including unauthorized access, misuse of Website content, or infringement of another person's rights.

Nothing in this section requires you to indemnify us for our own negligence, willful misconduct, legal violations, or other matters for which indemnification is prohibited by law.

11. Changes to These Terms

We may update these Terms of Use from time to time to reflect changes in our Website, services, business practices, or applicable legal requirements.

Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

If a change requires separate notice or consent under applicable law, we will follow the applicable requirements.

12. Governing Law and Jurisdiction

These Terms of Use will be governed by and interpreted in accordance with the laws of the State of Michigan, without regard to its conflict-of-law principles, except where applicable federal law or other applicable law requires otherwise.

Any legal action arising out of or relating to these Terms of Use or your use of the Website must be brought in a court of competent jurisdiction as permitted by applicable law.

Nothing in these Terms of Use is intended to waive, restrict, or limit any rights, remedies, or protections that cannot lawfully be waived, restricted, or limited under Michigan or federal law.

13. Severability and Entire Agreement

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

These Terms govern your use of the Website and do not supersede any separate agreements, patient consents, financial policies, or other terms that may apply to specific services.
